General Terms and Conditions of Business AURONOS AG - Buyer
These General Terms and Conditions (GTC) of AURONOS AG, Oberfeldstrasse 20, CH-8302 Kloten (hereinafter referred to as "AURONOS"), regulate a) the relationship between AURONOS and Buyers, in particular with regard to the use of the platform www.auronos.com
and
b) the contractual relationship between sellers and buyers in the case of purchase contracts concluded between them via the www.auronos.com platform. Subsidiarily, the provisions of the Swiss Code of Obligations shall apply.
www.auronos.com is an online marketplace, in particular for watches, jewellery and corresponding accessories (hereinafter "items"). Vendors offer items for sale to potential buyers on www.auronos.com.
Any natural person or legal entity that creates a profile as a seller on www.auronos.com and places items for sale is referred to as a seller.
A buyer is any natural or legal person who concludes a purchase contract with the respective seller in relation to an offer on www.auronos.com. Buyers must be at least 18 years of age.
Buyers must be at least 18 years old.
These GTC apply exclusively. Conflicting, supplementary or deviating terms and conditions of the supplier or the buyer require the express written confirmation of AURONOS in order to be valid.
The buyer confirms to accept these GTC comprehensively when using services of AURONOS and when using www.auronos.com.
These GTC are also translated into other languages. Only the German version is legally binding.
For reasons of better readability, the masculine form is used in these GTC when referring to persons and special nouns. Corresponding terms apply in principle to all genders for the purpose of equal treatment. The abbreviated form of language is for editorial reasons only and does not imply any value judgement.
www.auronos.com contains information about articles. All details on www.auronos.com (descriptions, illustrations, films and other details) are to be understood as approximate values only and do not represent any assurances of properties or guarantees made by or for which AURONOS is responsible. AURONOS makes every effort to ensure that all details and information on www.auronos.com are correct, complete, up-to-date and clearly arranged, but AURONOS cannot guarantee this either explicitly or implicitly. The responsibility for offers made on www.auronos.com lies exclusively with the respective provider.
AURONOS cannot guarantee that the articles listed on www.auronos.com are up-to-date and available for purchase. Therefore, all information provided by AURONOS on the articles is without guarantee and may change at any time and without notice.
Purchasers are prohibited from using data and content accessible on www.auronos.com in whole or in part to build up their own database or for any other use of their own.
Under no circumstances does a contract between AURONOS and the buyer come into being via www.auronos.com. AURONOS also does not act as an agent for the buyer. AURONOS also does not act as a representative of the seller. www.auronos.com is purely an intermediary portal. Any contracts for purchases are concluded directly between the sellers listed on www.auronos.com and the respective buyer. Any disputes in connection with the purchase of items are settled between the provider and the buyer themselves, without the involvement of AURONOS. AURONOS also does not own or have possession of the items offered for sale.
AURONOS, its agents, employees and auxiliaries are in no way responsible for the risks associated with the initiation and conclusion of transactions and are in no way liable for any damages that may arise as a result.
AURONOS is under no obligation to monitor the conduct of Suppliers and Buyers in connection with the use of the www.auronos.com website. In particular, AURONOS is entitled, but not obliged, to check the texts and images published by the providers on www.auronos.com for their legality or other admissibility in any way.
AURONOS is not obliged to operate the website www.auronos.com and may shut down the website at any time. Accordingly, the Buyer has no right to use the website www.auronos.com or to use any services on this website.
The use of the portal www.auronos.com is free of charge for the visitor or buyer.
For the payment of the purchase price, AURONOS acts in the name and on behalf of the provider only as a paying agent.
The sales prices quoted by the supplier for his respective offer are always inclusive of VAT. Any shipping and customs costs will be charged additionally, unless otherwise provided for, and are to be paid by the buyer. Shipping costs are shown separately in the purchase process.
The advertisements placed on www.auronos.com are not legally binding offers by the seller to conclude purchase contracts, but represent non-binding invitations to potential buyers to submit purchase offers to the seller.
The purchase contract shall be concluded when the seller accepts the purchase offer submitted by the buyer in the respective offer on www.auronos.com by pressing the "Buy" button by means of a written confirmation by e-mail.
The purchase contract arising between the provider and the buyer via www.auronos.com is governed by these GTC. The Swiss Code of Obligations shall apply on a subsidiary basis.
After conclusion of the contract, the buyer is obliged to pay the purchase price and the seller is obliged to provide the buyer with ownership of the purchased item. The item will only be handed over or dispatched after receipt of payment by AURONOS. Accordingly, the supplier is entitled to retain the item until full payment has been received from the buyer and, should full payment not be received, to withdraw from the contract.
The supplier grants the buyer an unconditional right of withdrawal for 14 days after receipt of the purchased item. For this purpose, the buyer must register the return on AURONOS. The right of withdrawal does not apply if the buyer does not return the item in question in its original packaging, unopened and complete with all accessories and together with the delivery note and the withdrawal form.
Returns must be registered on the customer account before the item is returned.
The costs for a return shipment are borne by the customer, who is therefore responsible for the shipment (liability for loss, damage, etc.).
The following items are excluded from the right of return:
SALE items, piercings, intimate jewellery, and customised items (e.g. engraved etc...).
Exercising the right of withdrawal leads to a reversal of the purchase contract. Returns to AURONOS are at the expense and risk of the buyer. Any payment already made (including shipping costs) will be refunded to the customer within 14 days.
The supplier has the right to demand compensation for damage, excessive wear and tear or loss of value due to improper handling and to deduct the reduction in value from the purchase price already paid.
Unless otherwise stated, the statutory provisions shall apply. Deviating warranty periods are noted in the item description. The guarantee excludes improper handling, wear and tear and loss. In case of warranty repair, the customer must contact the seller directly.
The buyer can use the payment options indicated in the order process. Payment is made directly at the end of the ordering process. The following payment options are available - Mastercard - Visa - American Express - Postfinance Card - Postfiance E-Finance - Twint - Apple Pay - Google Pay - Samsung Pay - Invoice An automatic credit check is carried out during the ordering process. The customer can only order with invoice if the creditworthiness check is positive.
Deliveries are sent by post or courier service to the address specified by the buyer. With the dispatch, benefit and risk are transferred to the customer. The delivery time is indicated with the article. When the parcel is handed over to Swiss Post, the customer will receive a consignment number (tracking ID) by e-mail. The shipment can be tracked online at any time using the tracking number. All deliveries are sent A-Post, insured and free of charge. Shipping is only possible to Switzerland and Lichtenstein. If you have any questions about shipping, please contact the seller directly. If the delivery cannot be delivered or if the buyer refuses to accept the delivery, the seller can dissolve the contract after notifying the buyer by e-mail and setting a reasonable deadline, as well as charging the buyer for the costs of the inconvenience. The Purchaser is obliged to inspect the delivered articles immediately after receipt of the delivery and to notify the Supplier in writing by e-mail within 3 calendar days of any defects for which the Supplier provides a warranty. Returns to the supplier shall be made for the account and at the risk of the buyer. The Purchaser shall send the items to the Vendor in their original packaging, complete with all accessories and together with the delivery note and a detailed description of the defects. If the examination by the supplier shows that the articles do not have any detectable defects, the supplier may charge the customer for the expenses, the return shipment or the possible disposal. - The following items are excluded from the right of return: SALE items, piercings, intimate jewellery, and customised items (e.g. engraved). AURONOS offers you a 14-day right of return. - Please note that there is an exception for certain items. For the following articles we cannot offer you a right of return, but a right of exchange: - Articles in the category Jewellery - Articles with a price of more than CHF 1'500.
If the warranty has not been excluded, the supplier shall, in the event of defects notified in good time, guarantee the freedom from defects and functionality of the item purchased by the customer during the agreed warranty period. It is at the discretion of the supplier to provide the warranty by free repair, equivalent replacement or by refunding the purchase price. Further claims are excluded. The warranty does not cover normal wear and tear or the consequences of improper handling or damage by the purchaser or third parties, or defects attributable to external circumstances. The warranty for parts subject to wear and tear is also excluded.
The purchaser is fully liable for his own activities and procedures on www.auronos.com. If a third party holds AURONOS, its employees or auxiliary persons liable for alleged infringements, the buyer in question will indemnify AURONOS in full, including any costs of legal representation.
AURONOS excludes all liability, irrespective of its legal basis, as well as claims for damages against AURONOS and any auxiliary persons and vicarious agents. In particular, AURONOS is not liable for temporary interruptions in the availability of the website www.auronos.com, for indirect damages and consequential damages, loss of profit or other personal injury, property damage and pure financial loss of the buyer and third parties. Further mandatory legal liability, for example for gross negligence or unlawful intent, remains reserved.
AURONOS is not liable for claims arising from contracts concluded between the supplier and the buyer.
AURONOS assures that it is the - is the owner of all rights to the website www.auronos.com and
- has no knowledge of claims by third parties which are directed against the rights to the website www.auronos.com.
The protection of the personal data of visitors to www.auronos.com is important to AURONOS. AURONOS takes the issue of data protection seriously and ensures appropriate security. AURONOS processes and maintains personal data in accordance with the provisions of the Swiss Federal Law on Data Protection (DSG), the Ordinance to the Swiss Federal Law on Data Protection (VDSG), the Telecommunications Act (TCA) and, where applicable, other data protection regulations, in particular the European Union's General Data Protection Regulation (GDPR).
The buyer agrees that AURONOS may use his data to carry out advertising measures (online or print), in particular to send him information about offers.
The purchaser of www.auronos.com has the option to object to these advertising purposes at any time by notifying AURONOS.
In all other respects, reference is made to the AURONOS data protection declaration, which can be viewed at www.auronos.com.
The rights and obligations arising from this contract are not transferable without the prior consent of AURONOS. The buyer agrees that the e-mail address provided by him serves as a communication channel to AURONOS and that information relevant to the contract is transmitted via this e-mail address. email address will be transmitted.
These GTC may be amended by AURONOS at any time. The new version comes into force through publication on the website www.auronos.com.
Should individual provisions of these GTC be wholly or partially invalid and/or ineffective, the validity and/or effectiveness of the remaining provisions or parts of such provisions shall remain unaffected. The invalid and/or ineffective provisions shall be replaced by provisions that come as close as possible in economic terms to the meaning and purpose of the invalid and/or ineffective provisions in a legally effective manner. The same shall apply in the event of any loopholes in the provision. In the event of disputes, Swiss substantive law shall apply exclusively, to the exclusion of conflict-of-law rules. The place of jurisdiction is Zurich.
